TERMS & CONDITIONS FOR “AOTEAROA ESCAPE” PROMOTION
21 OCTOBER – 31 DECEMBER 2023
- ACCEPTANCE OF TERMS AND CONDITIONS
- 1.1. By participating in the “Aotearoa Escape” promotion (the “Promotion”), each Participant (as defined below) confirms that he/she has read, understood and agrees to be bound by these terms & conditions set out herein, including any other requirements set out in any Promotion-related promotional material, and all amendments, additions, replacements and modifications thereto as may be made from time to time (the “Terms and Conditions”).
- 1.2. This Promotion is organised and administered by Comvita Singapore Pte. Ltd. (“Comvita”).
- 1.3. As a condition of entry into the Promotion, each Participant affirms and represents that he/she is above 18 years of age and agrees to be bound in all respects by these Terms and Conditions.
- 1.4. This Promotion is in no way affiliated, sponsored, or endorsed by Facebook and/or Instagram.
- PROMOTION ELIGIBILITY CRITERIA
- 2.1. The Promotion is open to persons:
- aged 18 years and above (as at the date of the prize draw);
- who is a legal resident of Singapore (citizens, permanent residents or holding a valid long term pass);
- who meet the Qualifying Spend (as defined below) requirement as set out in Clause 3; and
- who does not fall within the Excluded Categories, (each a “Participant” and collectively the “Participants”).
- 2.2. “Excluded Categories” refer to:
- directors and employees of Comvita, Synagie Corporation Ltd., VitaKids Pte. Ltd., Intigus Communications Sdn. Bhd., Rice Communications Pte. Ltd. and any other persons involved in organising, promoting and/or conducting the Promotion;
- immediate family members of persons who fall within the class of persons referred to in Clause 2.2 (a) above. “Immediate family members” mean spouses, children, parents, parents-in-law and siblings;
- any person who is or becomes insane, deceased, insolvent or is the subject of a criminal investigation, or has criminal proceedings instituted against him/her in any jurisdiction (at the time of entry and/or the draw);
- any person whose participation in and/or association with the Promotion may cause (in the sole and absolute opinion of Comvita) Comvita and/or the Promotion any disrepute, contempt, scandal, ridicule, or cause Comvita and/or the Promotion to be perceived unfavourably; and
- any other person or class of persons deemed ineligible or notified by Comvita as being ineligible from time to time.
- 2.3. Comvita reserves the right (in its sole and absolute discretion) to determine the eligibility of any person in relation to the Promotion, and Comvita may at any time during the Promotion (and whether before, during or after a Lucky Draw), disqualify any person from participating in the Promotion without providing any reason if it determines that such person does not meet the eligibility criteria above.
- PROMOTION MECHANICS AND CONDITIONS OF PARTICIPATION
- 3.1. The Promotion shall commence from 0800hrs (SGT) on 21 October 2023 to 2359hrs (SGT) on 31 December 2023. (the "Promotion Period").
- 3.2. . The Promotion consists of lucky draws ("Lucky Draw(s)") for the Grand Prize, First Prize and Bonus Prizes (as defined in Clause 5).
- 3.3. To be eligible for the Lucky Draw, each Participant shall spend a minimum of SGD50 in a single receipt (the “Lucky Draw Qualifying Spend”) on Comvita or HoneyWorld products within the Promotion Period at authorized channels only (as defined below) with the entry submitted as defined in clause 3.8.
- 3.4. All purchases must be made at the following authorized channels to be eligible:
- Comvita.com.sg and Comvita Official Stores at LazMall and Shopee Mall.
- Comvita x HoneyWorld Store at Takashimaya Shopping Center.
- All HoneyWorld Stores, Departmental Store counters (online included), including purchases made through quick commerce services like Deliveroo and Foodpanda.
- HoneyWorld.sg, HoneyWorld Official Stores at iShopChangi, KrisShop, Lazada, Qoo10, Robinsons Singapore and Shopee.
- Guardian Health & Beauty Stores and Estore.
- VitaKids Stores and Official Stores on Lazada and Shopee.
- 3.5. Each valid receipt entitles participants to entries based on the following:
- 1 entry for every SGD50 spent on Comvita or HoneyWorld products
- 5X entries multiplier for purchases of Comvita Collagen Peptide Manuka Honey Drink, Immune Bee™ Propolis PFL 60 Veg Caps, Night Rejuvenating Manuka Honey Drink and UMF™ 25+ Special Reserve Manuka Honey.
- 3X entries multiplier for purchases of Comvita products from Comvita.com.sg, Comvita Official Stores at LazMall and Shopee Mall, Comvita x HoneyWorld Store, HoneyWorld Stores and Departmental Store counters, HoneyWorld.sg and HoneyWorld Official Stores at iShopChangi, KrisShop, Lazada, Qoo10, Robinsons Singapore and Shopee
- Multipliers cannot be combined, with only the higher multiplier will be calculated.
- 3.6. Examples of entries calculations are as follows:
- Purchase of Comvita UMF™ 25+ Special Reserve Manuka Honey and Comvita Bee Propolis Oral Spray from Comvita.com.sg, at SGD 614.90 = 58 entries (55 + 3).
- Purchase of Comvita Collagen Peptide Manuka Honey Drink, Comvita Kids Soothing Manuka Honey Pops and HoneyWorld Manuka Blend 500g, from HoneyWorld Metro Causeway Point at SGD 144.90 = 6 entries (5 + 1).
- Purchase of Comvita UMF™ 10+ Manuka Honey 500g at Guardian Health & Beauty Paragon at SGD 115 = 2 entries.
- 3.7. Each entry must be submitted as follows:
- Full name as per NRIC/Long Term Pass, email address and last 4 digits of NRIC/FIN number
- A valid and legible picture of the Proof of Purchase made during the Promotion Period
- Submitted via WhatsApp to +65 94379356
- Submissions will not be accepted after 11.59pm, 7 January 2024
- 3.8. Comvita is not liable for any failure (for whatever reason) to submit an entry into the Promotion.
- WINNERS’ SELECTION
- 4.1. Winners are selected within 30 days after the Promotion Period has ended. Eligible participants will be selected by an automated randomization system and determined as winners.
- 4.2. Participants may send more than ONE (1) entry.
- 4.3. Each Proof of Purchase can only be used once. The Participant entries will be disqualified if the same Proof of Purchase is used for more than ONE (1) time.
- 4.4. Each participant is only eligible to win ONE (1) Grand Prize, or ONE (1) First Prize or ONE (1) Bonus Prize, irrespective of the number of entries received by Comvita.
- 4.5. The winners will be contacted by 31 January 2024 by the phone number and email address provided. Comvita will leave a message if the Winner does not answer, the Winner will have 72 hours to claim their Prize by making contact with Comvita. If contact has not been made following 72 hours after first contact, the Winner forfeits the Prize and a new Winner will take their place. Comvita would never request your bank account, credit card or any other financial details to enter a competition. If these are requested it is likely to be a scam, please delete the request and report to the service provider that the request came through. Comvita will only contact you via the email or phone number provided during the entry submission.
- 4.6. The decision made by Comvita is final and no further correspondence will be entered into.
- 4.7. Comvita shall publish and list the names of all winners on its website, available through https://www.comvita.com.sg.
- PRIZES DETAILS AND CLAIMING THE PRIZE
- 5.1. The following prizes have been allocated for the Promotion (“Prizes”):
- “Grand Prize” – One (1) winner: One 5 days 4 nights trip for 2 pax to New Zealand, from Singapore, inclusive of return flights, accommodation and local tour arrangements in New Zealand.
- “First Prize” – One (1) winner: One (1) Comvita UMF™ 25+ Special Reserve Manuka Honey
- “Bonus Prizes” – Three (3) winners: One (1) Comvita Health and Beauty Box consisting of Comvita UMF™ 5+ Manuka Honey 250g, Comvita Immune Bee™ Propolis PFL 15 Veg Caps 30s, Comvita Collagen Peptide Manuka Honey Drink and Comvita Night Rejuvenating Manuka Honey Drink.
- Grand Prize
- 5.2. The Grand Prize travel period will be made during the months of March or April 2024.
- 5.3. The Winner will be allowed to nominate a companion for the trip. Both the Winner and companion for the trip must be available for travel during the period specified with the necessary travel documentation
- 5.4. The Winner takes the Prize entirely at their own risk and indemnifies the Promoter in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with the Prize. Neither the Promoter nor any other person or party associated with this Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in this Promotion or with any Prize offered. The Winner is responsible for all insurance, tax or other costs that may be associated with the Prize.
- 5.5. The Winner and their travelling companion must travel together at all times. The Winner is responsible for transport from their residence to Singapore Changi Airport for flight departure and from Singapore Changi Airport to their residence upon returning.
- 5.6. Flight tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. The flight itinerary may have to be adjusted depending on the airline's departure city and their current flight schedule.
- 5.7. Any changes to travel dates or additional accommodation outside the travel period, or additional activities specified in the Prize details, made by the Winner, which incur additional costs, are to be paid by the Winner.
- 5.8. The Winner will be responsible for expenses including, but not limited to, and all other ancillary costs associated with redeeming the Prize. The Winner should consider obtaining travel insurance to protect themselves against additional costs incurred in the event of unforeseen circumstances.
- 5.9. The Prize must be taken as stated in these conditions and no compensation will be payable if the Winner is unable to use the Prize as stated. For the avoidance of doubt, if the Winner is, for whatever reason, unable to travel on a nominated date during this period, after the travel is ticketed, whether the failure was due to reasons beyond the Winner's control or otherwise, then the Winner will forfeit the Prize.
- 5.10. All travel is subject to the terms, conditions and restrictions of the Prize service providers. Any travelling companion included in the Prize (if applicable) accepts the Prize subject to these terms, conditions and restrictions as if references to the Winner in the relevant clauses were to the travelling companion.
- 5.11. Once the Winner and their travelling companion are confirmed and ticketed, the Winner will not be able to make changes to the booking. If the Winner and/or their travel companion are unable to travel on the designated dates, after the travel is ticketed, the Winner will forfeit the Prize, and no other negotiations will be entered into.
- 5.12. Further details with regard to the Grand Prize will be shared together during the winner announcement.
- First and Bonus Prize
- 5.13. First Prize and Bonus Prizes must be collected as stated and no compensation will be payable if a winner is unable to use the Prize. There shall be no refund or exchange for any partially used or unused prize
- General
- 5.14. Winners are required to present the original receipt of purchase during the claiming of Prizes.
- 5.15. Any receipt duplication will not be entertained and the prizes will be forfeited if the receipt is not original.
- 5.16. Save as specified herein, all other Prizes that remain unclaimed beyond 29 February 2024 shall be forfeited. All winners whose Prize have been forfeited hereunder shall not be entitled to any payment or compensation. Failure to respond to any notification from Comvita in relation to any Prize won, or to provide any information or material required for the redemption/collection of any Prize, shall be deemed to be a failure to claim/redeem such Prize. Comvita reserves the right to donate any unclaimed or unredeemed Prizes to such charities of its choice.
- 5.17. All Prizes are non-transferable, non-refundable and non-exchangeable for cash, credit, goods or benefits-in-kind, unless otherwise stated.
- 5.18. Comvita reserves the right to deny or claw back any Prize awarded to any winner should the winner subsequently be found to be disqualified or ineligible to participate in the Promotion. Comvita’s determination on all matters relating to the Promotion shall be final, conclusive and binding. No correspondence will be entertained.
- 5.19. Comvita may at any time and without notice in its sole and absolute discretion and without assigning any reason, substitute any Prize with any other item of a similar value.
- 5.20. Comvita makes no representation, warranty or undertaking whatsoever as to any implied terms or conditions with respect to any Prize. The Prizes provided are on an “as-is” basis.
- PERSONAL DATA
- 6.1. Participation in the Promotion requires the processing of Participants’ personal data, including name, NRIC/Passport number, email address and personal mobile number. Comvita may use participants’ personal data for the purposes of administering the Promotion, publicising and announcing the winners, matching personal data collected through this Promotion with other data Comvita holds about the Participant to optimise operations and services offered to participants through the Promotion and other platforms, statistical analysis, and improving the products and services that Comvita offers (the “Relevant Purposes”). Comvita may also disclose such personal data to any of its subsidiaries, affiliates, service providers and/or agents for the Relevant Purposes. By participating in the Promotion, Participants consent to Comvita’s collection, use, disclosure, storage and other processing of any personal data provided in accordance with all applicable privacy laws and Comvita’s Privacy Policy (https://comvita.com.sg/policies/privacy-policy).
- 6.2. Each participant represents and warrants that any personal data the participant discloses to Comvita is complete and accurate. Each Participant shall fully indemnify Comvita against any loss or damage that may result from his or her breach of this Clause 6.2.
- 6.3. As a condition to accepting a Prize, each winner consents to the collection and public disclosure of his/her name, area of residence and image recordings for publicity or commercial purposes in relation to the Promotion. Each winner further agrees to participate in any advertising, promotion, media interviews and publicity activities stipulated by Comvita in relation to the Promotion, and to provide and permit the use of his/her personal data for any future marketing efforts and media publicity by Comvita in relation to the Promotion. Accordingly, unless otherwise permitted by Comvita, winners shall not during any publicity or promotion activities in connection therewith, wear, put on, or do any other thing which may, in the reasonable opinion of Comvita, lead to the concealment of the winner’s facial appearance and identity. Failure to comply with this Clause 6.3 will result in disqualification and forfeiture of all relevant Prizes.
- 6.4. To promote and advertise the Promotion, Comvita reserves the right to engage authorised photographers and videographers to take photographs and/or video recordings. By participating in the Promotion, Participants consent to being photographed and recorded by authorised photographers and videographers and consent to Comvita use of such images, films or recordings for creating marketing and publicity materials for public transmission.
- GENERAL TERMS & CONDITIONS
- 7.1. Comvita reserves the right to disqualify any Participant who is found at any time (whether before or after the receipt of any Prize) to be in breach of the eligibility criteria contained in Clause 2. All Prizes awarded will be forfeited and shall be returned to Comvita promptly.
- 7.2. Comvita decision on all matters relating to the Promotion shall be final, conclusive and binding. No correspondence will be entertained.
- 7.3. To the fullest extent permitted by law, Comvita, its employees and its authorised agents (“Indemnified Parties”) shall not be liable to any Participant for any injury, damage, loss, cost or expense arising out of or in connection with the Promotion, and each Participant agrees to indemnify and hold the Indemnified Parties harmless from and against any and all claims, damage, losses, costs or expenses suffered or incurred by the Indemnified Parties in relation to the Promotion.
- 7.4. Comvita reserves the right to vary these Terms and Conditions at any time at its absolute discretion without notice. In the event of any inconsistency between these Terms and Conditions with any other form of publicity collaterals relating to the Promotion, these Terms and Conditions shall prevail
- 7.5. The Promotion and these Terms and Conditions are governed by the laws of the Republic of Singapore. Comvita and all Participants hereby submit to the exclusive jurisdiction of the Singapore courts in the determination of any matter or dispute arising in connection therewith.
- 7.6. These Terms and Conditions are not intended to confer rights to any third party under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any provision of these Terms and Conditions, and the operation of the said Act is hereby excluded.
